Ditjen Pajak telah menetapkan tarif fiskal bagi yang tak memiliki Nomor Pokok Wajib Pajak (NPWP) sebesar Rp 2,5 juta untuk setiap orang yang bepergian ke luar negeri dengan menggunakan pesawat udara. Sementara via angkutan laut bagi yang tak memiliki NPWP akan dikenai fiskal Rp 1 juta.Pembayaran Fiskal Luar Negeri (FLN) itu merupakan pembayaran angsuran Pajak Penghasilan (PPH) yang dapat dikreditkan terhadap PPH yang terutang pada akhir tahun oleh Wajib Pajak Orang Pribadi (WP OP) yang bersangkutan setelah memiliki NPWP.Pengenaan fiskal itu berarti naik 150% dibandingkan fiskal via angkutan udara yang saat ini sebesar Rp 1 juta. Sementara untuk via angkutan laut, fiskal berarti naik 100% dari saat ini sebesar Rp 500 ribu. Ketentuan ini berlaku mulai 1 Januari 2008 untuk WP OP yang berusia 21 tahun. Keputusan ini akan berlaku hingga 31 Desember 2010.Pengecualian kewajiban membayar FLN bagi WP OP yang bepergian ke luar negeri dilakukan secara otomatif untuk WP OP tertentu dengan cara menerbitkan Surat Keterangan Bebas Fiskal Luar Negeri (SKBFLN).FISKAL LUAR NEGERIPengertianFiskal Luar Negeri (FLN) adalah Pajak Penghasilan (PPh) yang wajib dibayar oleh setiap Orang Pribadi yang akan bertolak ke luar negeri.Pembayaran dan Pengkreditan FLN (mulai 1 Januari 2009) untuk yang tidak memiliki NPWP (Nomor Pokok Wajib Pajak):1. Tarif Fiskal Luar Negeri adalah :* Rp. 2.500.000,- (dua juta lima ratus ribu rupiah), untuk setiap kali perjalanan dengan menggunakan pesawat udara;* Rp. 1.000.000,- (satu juta rupiah), untuk setiap kali perjalanan dengan menggunakan kapal laut;1. Dilaksanakan dengan menggunakan Tanda Bukti Pembayaran Fiskal Luar Negeri (TBFLN) di bandar udara atau pelabuhan laut keberangkatan ke luar negeri maupun tempat lain yang ditentukan oleh Direktur Jenderal Pajak;2. Anggota keluarga sedarah semenda dalam garis keturunan lurus serta anak angkat yang menjadi tanggungan sepenuhnya, TBPFLN diisi dengan nama / identitas anggota keluarga yang bertolak ke luar negeri, dan NPWP yang dicantumkan adalah NPWP kepala keluarga.3. Pembayaran FLN bagi Wajib Pajak Orang Pribadi (WP OP) Dalam Negeri merupakan pembayaran PPh pasal 25 yang dapat dikreditkan dengan PPh yang terutang pada SPT Tahunan PPh untuk tahun pajak yang bersangkutan;4. Pembayaran FLN bagi WP OP yang tidak mempunyai NPWP dapat dikreditkan dengan PPh terutang dengan syarat WP OP tersebut mendaftarkan diri untuk memperoleh NPWP serta menyampaikan SPT Tahunan PPh ke Kantor Pelayanan Pajak (KPP) tempat domisili WP;5. Pembayaran FLN bagi karyawan yang bertolak ke Luar Negeri tidak dapat dikreditkan dengan PPh Pasal 21 oleh karena merupakan pembayaran PPh Pasal 25.6. Pembayaran FLN bagi karyawan (tidak termasuk isteri dan anak), yang ditanggung pemberi kerja merupakan angsuran PPh pasal 25 bagi pemberi kerja yang dapat dikreditkan terhadap PPh terutang dalam SPT Tahunan Pemberi Kerja untuk tahun pajak yang bersangkutan.Bagi WP OP yang bebas fiskal karena memiliki NPWP, maka:1. Menyerahkan fotokopi kartu NPWP atau Surat Keterangan Terdaftar (SKT) atau Surat Keterangan Terdaftar Sementara (SKTS), fotokopi paspor dan boarding pass ke petugas Unit Pelaksana Fiskal Luar Negeri (UPFLN).2. Jika kartu NPWP atas nama Kepala Keluarga, maka anggota keluarga yang akan berangkat ke luar negeri harus melampirkan fotokopi kartu keluarga.3. Petugas UPFLN menerima dan meneliti fotokopi kartu NPWP/SKT/SKTS, fotokopi paspor dan boarding pass serta fotokopi kartu keluarga, kemudian menginput NPWP pada aplikasi yang tersedia.4. Apabila NPWP dinyatakan sah (valid), maka petugas UPFLN menempelkan stiker bebas fiskal pada bagian belakang boarding pass yang ditujukan untuk penumpang.5. Penumpang menyerahkan boarding pass yang telah ditempel stiker Bebas Fiskal kepada petugas konter pengecekan FLN untuk diteliti.6. Penumpang tujuan luar negeri tetap wajib membayar FLN jika:* Tidak menyerahkan fotokopi kartu NPWP/SKT/SKTS* Menyerahkan fotokopi NPWP/SKT/SKTS namun check digit menyatakan tidak valid* Menyerahkan fotokopi kartu NPWP/SKT/SKTS yang dimiliki oleh Kepala* Keluarga namun tidak melampirkan kartu keluarga atau melampirkan kartu keluarga tetapi nama penumpang tidak tercantum dalam susunan kartu keluarga itu.Pengecualian Fiskal Luar NegeriOrang Pribadi yang akan bertolak ke luar negeri dikecualikan dari pembayaran FLN dengan cara sebagai berikut :* pembebasan langsung, diberikan oleh pejabat Direktorat Jenderal Pajak yang berwenang;* pembebasan melalui pemberian Surat Keterangan Bebas Fiskal Luar Negeri (SKBFLN) diterbitkan Unit Fiskal Luar Negeri (UPFLN) DJP.Pembebasan Langsung:* Anggota Korps Diplomatik, Pegawai Perwakilan Negara Asing. staf dari Badan-Badan Perserikatan Bangsa Bangsa (PBB). tenaga ahli dalam rangka kerja sama teknik dan staf dari Badan/ Organisasi internasional yang mendapat persetujuan Pemerintah RI, sepanjang mereka bukan Warga Negara Indonesia (WNI) dan disamping jabatan resminya tidak melakukan pekerjaan lain atau kegiatan usaha di Indonesia beserta anggota keluarga dan pembantu rumah tangganya yang bukan WNI. * Pejabat negara, anggota Tentara Nasional Indonesia (TNI) atau Polisi Republik Indonesia (POLRI) dan Pegawai Negeri Sipil (PNS) yang bertolak ke luar negeri dalam rangka dinas yang menggunakan Paspor Dinas, dan dilengkapi dengan surat tugas/perjalanan dinas ke luar negeri untuk setiap kali keberangkatan. Dalam hal keberangkatannya ke Luar Negeri dalam rangka penempatan di luar negeri, pembebasan diberikan juga kepada isteri dan anak-anaknya.* Anggota TNI atau POLRI yang mendapat tugas sebagai pasukan PBB atau dalam rangka latihan bersama dengan pasukan negara lain di luar negeri.* Petugas imigrasi yang melakukan tugas pemeriksaan keimigrasian dalam pesawat terbang perusahaan penerbangan nasional atau kapal laut perusahaan pelayaran nasional. * Jemaah haji yang penyelenggaraannya dilakukan oleh Departemen Agama dan petugas pelaksana pemberangkatan haji yang pembiayaannya dibebankan pada dana ONH. * Penduduk Indonesia yang melakukan perjalanan lintas batas wilayah RI dengan mempergunakan Pas Lintas Batas sesuai dengan perjanjian lintas batas dengan negara terkait;* Orang asing yang berada di Indonesia dengan visa turis, transit, visa sosial budaya, visa kunjungan usaha, dan tidak menerima atau memperoleh penghasilan dari Indonesia. * Orang asing yang karena sesuatu hal diperintahkan oleh Pemerintah Indonesia untuk meninggalkan wilayah Republik Indonesia.* Orang Pribadi yang bertempat tinggal dalam wilayah Kerjasama Ekonomi Sub regional ASEAN yang bertolak ke luar negeri dalam daerah kerja sama melalui pelabuhan atau tempat pemberangkatan ke luar negeri dalam daerah kerjasama.* Orang Pribadi yang bertempat tinggal dalam wilayah Kerjasama Ekonomi Sub regional Indonesia-Australia (AIDA) yang bertolak ke Australia melalui pelabuhan atau tempat pemberangkatan ke luar negeri dalam daerah kerjasama kecuali Bali.Pembebasan melalui pemberian SKBFLN:1. Anggota TNI atau POLRI dan PNS yang bertugas dibidang keamanan dan pelayanan pemerintahan di daerah perbatasan yang melaksanakan tugas dinas ke luar negeri dalam rangka kerja sama dengan negara yang berbatasan;2. Penduduk Indonesia yang bertempat tinggal tetap di Pulau Batam yang mempunyai Kartu Tanda Penduduk yang diterbitkan oleh pihak yang berwenang di pulau tersebut, sepanjang mereka telah dipotong Pajak Penghasilan oleh pemberi penghasilan atau telah terdaftar sebagai wajib pajak dan telah memenuhi kewajiban Pajak penghasilannya pada Kantor Pelayanan Pajak Batam. 3. Tenaga Kerja Warga Negara Asing pendatang yang bekerja di pulau Batam, pulau Bintan ,pulau Karimun, sepanjang mereka telah dipotong PPh Pasal 21/26 oleh pemberi kerja, SKBFLN diterbitkan oleh UPFLN Direktorat Jenderal Pajak di daerah setempat;4. Orang asing yang menerima atau memperoleh penghasilan dari Indonesia yang tidak bertempat tinggal atau tidak bermaksud menetap di Indonesia dan berada di Indonesia tidak lebih dari 183 hari (seratus delapan puluh tiga) dalam jangka waktu 12 (dua belas) bulan sepanjang atas penghasilan tersebut telah dipotong PPh pasal 26 oleh pemberi penghasilan. 5. Mahasiswa atau pelajar asing yang berada di Indonesia dalam rangka belajar dengan rekomendasi dari pimpinan sekolah atau perguruan tinggi yang bersangkutan dan tidak menerima atau memperoleh penghasilan dari Indonesia. 6. Orang asing yang berada di Indonesia dalam rangka melakukan penelitian dibidang ilmu pengetahuan dan kebudayaan dibawah koordinasi Lembaga Ilmu Pengetahuan Indonesia atau lembaga resmi Pemerintah lainnya serta Departemen Pendidikan Nasional, sepanjang tidak menerima atau memperoleh penghasilan dari Indonesia. 7. Orang asing yang berada di Indonesia dalam rangka pelaksanaan program kerjasama teknik dengan mendapat persetujuan Sekretariat Kabinet serta tidak menerima atau memperoleh penghasilan dari Indonesia. 8. Orang asing yang berada di Indonesia dalam rangka melakukan tugas sebagai anggota misi keagamaan dibawah koordinasi Departemen Agama dan misi kemanusiaan dibawah koordinasi Departemen terkait. 9. Penyandang cacat atau orang sakit yang akan berobat ke luar negeri atas biaya organisasi sosial termasuk 1 (satu) orang pendamping dengan persetujuan Menteri Kesehatan10. Anggota Korps Diplomatik, Pegawai Perwakilan Negara Asing, staf dari Badan-Badan Perserikatan Bangsa Bangsa, tenaga ahli dalam rangka kerja sama teknik dan staf dari Badan/ Organisasi internasional beserta isteri dan anak-anaknya yang merupakan anggota keluarga seperti yang dimaksud dalam angka 1 ;11. Anak-anak yang berangkat ke Luar Negeri sepanjang umurnya tidak melebihi 12 tahun berdasarkan Bukti Surat kependudukan atau paspor yang bersangkutan.12. Orang pribadi yang berasal dari bekas propinsi Timor Timur yang berada di Indonesia dalam status pengungsi, yg telah memutuskan menjadi Warga Negara bekas Propinsi Timor Timur dan akan kembali Ke Timor Timur, berdasarkan rekomendasi Palang Merah Indonesia .13. WNI yang akan bekerja di Luar Negeri dalam rangka program pengiriman TKI dengan persetujuan Menteri Tenaga Kerja.14. Awak pesawat terbang dan awak kapal laut yang beroperasi di jalur internasional atau yang melakukan penerbangan, pelayaran, dan operasi berdasarkan perjanjian carter angkutan.15. Anggota misi kesenian, misi Olah raga dan misi keagamaan serta misi dagang atau pameran yang mewakili pemerintah RI di luar negeri.16. Mahasiswa atau pelajar Indonesia yang pergi ke Luar Negeri serta guru Indonesia dalam rangka program resmi pertukaran mahasiswa atau pelajar atau guru yang diselenggarakan oleh Pemerintah atau Badan Asing dengan persetujuan Menteri terkait. 17. WNI yang bertempat tinggal tetap di luar negeri yang memiliki tanda pengenal resmi sebagai penduduk luar negeri tersebut dan tidak menerima atau memperoleh penghasilan dari Indonesia sepanjang berada di Indonesia tidak lebih dari 183 (seratus delapan puluh tiga) hari dalam jangka waktu 12 (dua belas) bulan dan pembebasan tersebut hanya diberikan untuk 4 (empat) kali dalam masa 1 (satu) tahun takwim.Demi kepentingan anda sendiri, setiap Warga Negara Indonesia (WNI) yang berada di luar negeri seyogyanya melaporkan keberadaan dirinya kepada Perwakilan RI setempat apabila akan tinggal lebih dari 5 (lima) hari di negara yang dikunjungi. Hal ini berarti setiap WNI yang berada di wilayah Jerman, baik itu untuk tujuan belajar, kuliah, wisata/jalan- jalan/singgah sementara, bekerja, dan tentunya mereka yang akan menetap untuk selamanya diharapkan memiliki kesadaran untuk melaporkan dirinya ke Perwakilan RI terdekat. Lapor diri pada Perwakilan RI setempat sangat besar manfaatnya. Tentunya sangat diharapkan agar setiap WNI yang berada di luar negeri menjaga dirinya masing-masing dan senantiasa dijauhi dari kesulitan dan berbagai hambatan. Oleh karena itu sempatkanlah waktu untuk melaporkan keberadaan anda selama di Jerman kepada Perwakilan RI, baik itu KBRI Berlin, KJRI Hamburg ataupun KJRI Frankfurt.Persyaratan Lapor Diri di KBRI Berlin1. Bagi masyarakat yang akan menetap di Jerman :* Datang langsung ke Bidang Imigrasi KBRI Berlin (bagi yang tinggal di Berlin dan daerah sekitarnya) dengan membawa paspor. * Mengisi formulir secara lengkap dengan dibubuhi tandatangan. * Membawa Fotokopi Akte Kelahiran dan Akte Nikah (bagi yang sudah menikah)* Membawa Surat Keterangan Bekerja / Sekolah* Membawa Anmeldebestätigung dari Kantor Polisi/Pemda setempat* Membawa 1 buah pasfoto terbaru.1. Bagi pemegang Paspor Dinas :* Datang langsung ke Bidang Konsuler KBRI Berlin (bagi yang tinggal di Berlin dan daerah sekitarnya) dengan membawa paspor.* Mengisi formulir secara lengkap dengan dibubuhi tandatangan.* Membawa/menyerahkan fotokopi Surat Keterangan Sekkab/Sekneg/ Surat Penugasan di Luar Negeri.* Membawa 2 buah Pasfoto terbaru.1. Bagi Wisatawan/Kunjungan Singkat :* Datang langsung ke Bidang Imigrasi/Konsuler KBRI Berlin dengan membawa paspor dan 1x pasfoto ukuran sesuai paspor.* Mengisi formulir secara lengkap dengan dibubuhi tandatangan.Catatan :Bagi mereka yang bertempat tinggal jauh dari kota Berlin, dimungkinkan untuk melaporkan diri melalui pos dengan persyaratan sebagaimana tersebut di atas ditambah dengan amplop jawaban/pengiriman berperangko sebesar ¤ 3,50 (tercatat). KBRI Berlin tidak bertanggung jawab atas kehilangan atau kerusakan paspor selama dalam proses pengiriman via pos.Catatan :Angka (huruf) 5, 6, 7, 8, 15 dan 16 tidak berlaku bagi isteri, anak-anak, dan anggota keluarga lainnya.Cara memperoleh SKBFLN1. Mengajukan permohonan kepada Direktur Jenderal Pajak melalui Kepala Kantor Wilayah Direktorat Jenderal Pajak atau Kepala Kantor Pelayanan Pajak di tempat keberangkatan ke luar negeri.2. Bila permohonan disetujui, maka akan diberikan rekomendasi pembebasan FLN.3. Berdasarkan rekomendasi tersebut, unit FLN di pelabuhan laut atau bandar udara tempat pemberangkatan akan menerbitkan SKBFLN.4. Bagi WP luar negeri yang bekerja di Indonesia untuk kepentingan kantor perwakilan wilayah perusahaan asing, permohonan pembebasan kewajiban membayar FLN diajukan kepada Kepala Kantor Wilayah atau Kepala Kantor Pelayanan Pajak sebagai unit pelaksana FLN dimana kantor perwakilan wilayah perusahaan asing tersebut berkedudukan, sebagai pengganti SKBFLN.5.
