Gubernur Bali Made Mangku Pastika akhirnya menetapkan Upah Minimum Propinsi (UMP) dan Upah Minimum Kabupaten/Kota (UMK) tahun 2009. Melalui Pergub Bali No.86/2008 tertanggal 20 November 2008 ditetapkan UMP 2009 yakni Rp 760.000 per bulan atau naik sekitar 11,33 persen dari tahun sebelumnya. Sementara UMK 2009 bervariasi sesuai dengan keputusan Dewan Pengupahan di Kabupaten/Kota masing-masing.Adapun Upah Minimum di Kabupaten/Kota se-Bali yang tertinggi yakni Kota Denpasar Rp 952.000 per bulan dan terendah Kabupaten Bangli Rp 760.500. Sementara UMK Badung Rp 950.000, Gianyar Rp 852.5000, Karangasem Rp 815.606, Jembrana Rp 812.500, Tabanan Rp 777.000, Klungkung Rp 767.000 dan Buleleng Rp 765.000. UMP dan UMK berlaku efektif sejak 2 Januari 2009.Dalam Pergub Bali yang diperoleh dari Sekretariat DPC FSP-Par Badung itu, juga dicantumkan beberapa hal yang harus dipatuhi semua pihak terkait. Antara lain pada pasal 2 disebutkan, Upah Minimum meliputi upah bulanan yang terdiri dari upah pokok termasuk tunjangan tetap, berlaku bagi pekerja lajang dengan masa nol tahun sampai satu tahun termasuk pekerja dalam masa percobaan.Pada pasal 3, besarnya upah pekerja yang memiliki masa kerja di atas satu tahun ditetapkan berdasarkan kesepakatan secara musyawarah oleh pengusaha dan pengurus Serikat Pekerja/Serikat Buruh dengan mempertimbangak kemampuan perusahaan. Lebih jauh mengenai hal ini telah diatur dalam Kepmen Nakertrans RI No. Kep-49/MEN/IV/2004 pasal 92 tentang struktur dan sekala upah.Pada pasal 4 disebutkan, perusahaan yang telah memberikan upah lebih tinggi dari Upah Minimum dilarang mengurangi atau menurunkan upah tersebut. Dalam Pergub Bali No.86/2008 juga ditetapkan pengusaha yang tidak mampu melaksanakan Upah Minimum dapat mengajukan penangguhan pelaksanaan upah minimum kepada Gubernur melalui Disnakertrans Propinsi Bali (pasal 5).Ketua DPC FSP-Par Badung, Putu Satyawira mengatakan, pasal-pasal yang dicantumkan dalam Pergub Bali tertanggal 20 Nopember 2008 itu mengacu pada UU No.13/2003 tentang Ketenagakerjaan dan Kepmen Nakertrans RI No. Kep-49/MEN/IV/2004. Misalnya tentang penangguhan pelaksanaan upah minumum tercantum dalam pasal 3 dan 4 Kepmenakertrans RI No. Kep-49/MEN/IV/2004.Pada pasal 3 ayat (1) disebutkan, permohonan penangguhan pelaksanaan upah minimum diajukan oleh pengusaha kepada Gubernur melalui instansi yang tertanggung jawab di bidang ketenagakerjaan propinsi paling lambat sepuluh hari sebelum berlakunya upah minimum. Sementara di pasal 4 dikatakan, permohonan penangguhan pelaksanaan upah minimum harus dilengkapi sejumlah dokumen.
